These Terms of Service govern access to and use of the maimood.com website and the photography services provided by Maimood Photography. By accessing the website or engaging the studio's services, users and clients agree to these terms. These terms are governed by Egyptian law.
A. Website Use
Access to maimood.com is provided for informational purposes. The website describes the photography services offered by Maimood Photography and provides a means for visitors to make enquiries. The content of this website does not constitute a binding offer or contract.
Users may not use this website for any unlawful purpose or in any manner that could damage, disable or impair the website. Automated scraping, crawling or harvesting of website content without written permission is prohibited.
The studio reserves the right to modify or discontinue any part of the website at any time without notice. The studio is not liable for any loss resulting from such modifications or discontinuation.
All content on this website — including text, images, graphics and design elements — is the property of Maimood Photography or its licensors and is protected by Egyptian copyright law.
B. Services Overview
Maimood Photography provides professional photography services including portrait sessions, wedding coverage, corporate event photography and product photography. Services are delivered by experienced photographers and are available to clients across Egypt.
The studio operates from Alexandria and travels to client locations across Egypt. All professional requirements and logistics are managed by the studio. Clients are not required to hold any special permits or credentials to engage these services.
Service descriptions on this website are provided for general informational purposes. Specific service terms for any engagement are set out in the written booking summary provided to the client before a booking is confirmed.
C. Bookings and Deposits
A photography session is confirmed only upon receipt of a signed booking summary and the agreed deposit payment. Enquiries and consultations do not constitute bookings and do not reserve dates in the studio's calendar.
The booking summary sets out the specific terms of the engagement including session type, date, duration, location, deliverables, total price and deposit amount. The client should review the booking summary carefully before signing.
Deposits are non-refundable except in circumstances where the studio cancels the session due to reasons within the studio's control. The deposit amount is specified in the booking summary and is deducted from the total price.
D. Cancellation and Rescheduling
Cancellation by the client after a booking has been confirmed will result in forfeiture of the deposit. Where the client cancels within 14 days of the session date, additional cancellation fees may apply as specified in the booking summary.
Rescheduling requests must be made in writing. Rescheduling is subject to the studio's availability on the new requested date. The studio will make reasonable efforts to accommodate rescheduling requests made with adequate notice.
Where the studio is unable to fulfil a confirmed booking due to circumstances within the studio's control, the studio will notify the client as soon as practicable and will refund any deposit paid. The studio's liability in such circumstances is limited to the refund of the deposit.
Where a session is affected by circumstances outside the studio's control (including extreme weather, illness or force majeure events), the rescheduling and cancellation terms in Section J apply.
E. Payment Terms
The total price for any session is as specified in the booking summary. Payment of the deposit is required to confirm the booking. The remaining balance is due on the day of the session unless otherwise agreed in writing.
Accepted payment methods are bank transfer and cash. All payments are documented by the studio. Where payment is made by bank transfer, the client should retain proof of transfer.
Invoices are provided for all bookings. Where a client requires a specific invoice format for accounting purposes, this should be communicated to the studio at the time of booking.
Late payment of the remaining balance may result in delay in delivery of the finished images. The studio reserves the right to withhold delivery until full payment has been received.
F. Intellectual Property
All photographs produced by Maimood Photography are the intellectual property of the studio and are protected by Egyptian copyright law and applicable international conventions. Copyright in all photographs vests in the studio immediately upon creation.
The studio retains the right to use photographs produced in the course of its services for portfolio, promotional and educational purposes, unless the client has requested otherwise in writing at the time of booking. Where a client requests that photographs not be used for promotional purposes, this will be noted in the booking summary.
Clients may not claim ownership of or copyright in any photographs produced by the studio. The client's rights in the photographs are limited to the usage licence granted under Section G below.
G. Image Usage Rights
Upon full payment of all amounts due, the studio grants the client a non-exclusive licence to use the delivered photographs for the purpose described in the booking summary. The scope of the licence varies by session type:
Portrait and family sessions: Personal use only. This includes printing, sharing with family and friends, and use on personal social media accounts. Commercial use is not permitted under this licence.
Corporate and commercial sessions: Commercial use as described in the booking summary. The licence covers use in the specific context agreed at booking. Use outside that context requires a separate agreement.
Wedding sessions: Personal use. This includes printing, sharing on personal social media, and use in personal publications. Use in commercial contexts requires written permission from the studio.
The client may not sublicense, sell or transfer usage rights to third parties without the studio's written consent.
H. Client Obligations
The client is responsible for ensuring that all individuals who will be photographed have given their consent to be photographed and for the resulting images to be used as described in the booking summary. For sessions involving minors, the client must be the parent or legal guardian or must have obtained appropriate consent.
The client is responsible for ensuring access to the agreed session location at the agreed time. Where a venue requires its own photography approval, the client is responsible for obtaining that approval in advance.
The client agrees to treat the photographer and any studio personnel with respect during the session. The studio reserves the right to terminate a session where the behaviour of the client or other individuals present makes it impractical to continue.
I. Limitation of Liability
The studio's liability to the client in connection with any session is limited to the total amount paid by the client for that session. The studio is not liable for any indirect, consequential or special loss, including loss of profit, loss of opportunity or reputational loss.
The studio is not liable for the loss or corruption of photographic files after delivery to the client. Clients are advised to back up delivered files promptly and maintain their own copies.
Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Egyptian law.
J. Force Majeure
Neither party is liable for failure to perform its obligations under a booking where that failure results from circumstances beyond its reasonable control, including natural disasters, acts of government, civil unrest, pandemic conditions or infrastructure failures.
Where a force majeure event prevents a session from taking place, the parties will work together in good faith to reschedule. Where rescheduling is not possible, the deposit may be retained by the studio as reasonable compensation for preparation costs incurred, unless the parties agree otherwise in writing.
K. Governing Law and Disputes
These terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt. Any dispute arising from these terms or from the studio's services will be subject to the exclusive jurisdiction of the courts of Alexandria, Egypt.
Before initiating formal proceedings, the parties agree to attempt to resolve any dispute through good-faith negotiation. Either party may initiate this process by sending written notice to the other describing the nature of the dispute and the resolution sought.
L. Amendments
These Terms of Service may be updated from time to time. The current version will always be published at maimood.com/terms.html with a "Last Updated" date. The terms applicable to any particular booking are those in effect at the time the booking summary is signed.
Continued use of this website after any amendment constitutes acceptance of the revised terms for website use purposes. For service engagements, the signed booking summary governs the specific terms of that engagement.
